Penalty Assessment: (Traffic Infraction)
The citation you have received is a Penalty Assessment and may be mailed. The fine entered on the reverse side is
the minimum fine for the stated violation(s) as required by Law and specified in Colorado Revised Statutes or Eagle
County Model Traffic Code. To use this method of fine payment and avoid additional court costs, the fine MUST be
mailed to the Motor Vehicle Division or Eagle County Sheriff’s Office and must be post marked no later than 20
days from the date of issuance of the citation. If not postmarked by that date, you are required to appear in court
at the time, date and place shown or may pay the fine and costs to the court clerk within two days of the date
shown at the location shown on the front of this ticket. Failure to pay the fine or appear in court will result in a
judgement being entered against you and the points will be entered on your driving record. Additionally, you will
not be able to renew or procure a driver’s license until the Judgement is satisfied with the court shown. Your
failure to pay the fine or appear in court constitutes a separate offense of “Failure to Obey a Summons” and a
warrant will be issued for your arrest.
BY PAYING THIS PENALTY ASSESSMENT, YOU ACKNOWLEDGE GUILT FOR THE CHARGES SPECIFIED HERIN AND
WAIVE THE FOLLOWING:
-The right to remain silent and if you give up the right to remain silent, anything you say can be used against you.
-The right to be informed on the charges against you and the possible penalty for each charge.
-The right to be represented by an attorney, and if indigent and the charge carries a possible jail sentence, to have
an attorney appointed by the court.
-The right to deny the allegations against you and to have a hearing before a referee, Judge or jury if applicable.
-The right to have your guilt or liability proved beyond a reasonable doubt.
-The right to testify, subpoena witnesses, presents evidence, and cross-examines witnesses for the state.
-The right to have a speedy and public trial or final hearing.
-The right to appeal the decisions to a higher court.
AUTOMATIC POINT REDUCTION PENALTY ASSESSMENT: Penalty Assessment Citations that are paid within 20 days
as stipulated above will result in an automatic point reduction as listed below:
1. For violations having an assessment of three or more points, the points will be reduced by two points.
2. For violations having an assessment of two points, the points will be reduced by one point.
